New York, NY—NYC Mayor Mamdani just hired a former Planned Parenthood lawyer to prosecute perceived violators of New York’s civil rights code which includes abortion. This is a new threat posed to Christian pro-life pregnancy centers already SLAPP’d by New York Attorney General Letitia James. Rev. Jim Harden, CEO of CompassCare said, “Given the current financial straights facing NYC, it would behoove Mayor Mamdani to not waste taxpayer money in frivolous lawsuits, investigations and other attacks against Christian pro-life organizations like CompassCare.”
During his bid for New York City Mayor, Zohran Mamdani promised to “protect New Yorkers” from Christian pro-life pregnancy centers which he falsely claims deceive women. He said he would seek enforcement of NYC ordinance Rule 17, through Consumer Affairs. Rev. Harden doubted Mamdani’s initial attack strategy saying, “It is a legal and potentially embarrassing dead-end for Mamdani to accuse medical professionals of consumer fraud for informing women of the dangers of chemical abortion, which sends 1 in 10 women to the ER,” and its possible reversal. Rev. Harden went on to say, “To make matters worse for Mamdani, his Rule 17 enforcement plan is based on businesses intentionally defrauding a customer. Providing free medical care as non-profits, by definition, means CompassCare is not doing business at all.”
So Mamdani needs a new plan, seemingly opening up a new line of attack by naming former Planned Parenthood attorney, Christine Clarke, the Commissioner for the Commission for Human Rights (CHR). Mamdani says her job is to “[enforce] the law to protect New Yorkers….” Sound familiar?
NYC’s CHR has investigative and prosecutorial authority. The complete policy can be found here. Basic NYC Civil Rights to be protected include among a host of other things, “sexual and reproductive health decisions.” Translation: According to New York’s civil rights code, abortion is a civil right to be protected.
But what happens when CompassCare refuses to refer or provide abortion, or refuses to hire pro-abortion staff, which we do consistently? The CHR could interpret these Christian pro-life positions as a conspiracy to violate a civil right.
And what is the extent of the power of the CHR? The policy states, “A city agency is hereby created with power to eliminate and prevent discrimination from playing any role in actions relating to employment, public accommodations … and to take other actions against prejudice, intolerance, bigotry, discrimination … and the commission established hereunder is hereby given general jurisdiction and power for such purposes.”
How does this work? CHR receives complaints and determines if there is probable cause for investigation. If it is so determined, then an investigation is opened after which they prosecute. If proven guilty, the defendant could be fined a crippling $250,000 per violation!
This civil rights abortion protectionism in NYC is supported at the NY State level after the passage of Prop 1, making sexual and reproductive decision-making a civil right in the State Constitution too. AG James and Gov. Hochul launched the Empire State Freedom Initiative to seek out violations of the new civil rights.
Rev. Harden wonders, “Time will tell if Mayor Mamdani’s political naiveté combined with his abortion zeal will betray his better judgement to deploy his new social enforcement Czar sooner than later.”
