September 22, 2026 – Rochester, NY: Rev. Jim Harden has delivered sample Personhood Clarification Act language to congressional leaders as Sen. Josh Hawley advances legislation targeting chemical abortion and mifepristone. Harden’s proposal would clarify constitutional personhood protections to cover all human beings from fertilization through natural death, including embryos created through IVF.

Today, Rev. Jim Harden, CEO of CompassCare, as part of ongoing conversation with notable congressional leaders in the House and Senate, delivered sample Personhood Clarification Act language for consideration. Days earlier, on September 16, Sen. Josh Hawley unveiled the Declaration for Life with Christian leaders and called on lawmakers to support his Safeguarding Women from Chemical Abortion Act.
With seven co-sponsors in the Senate, and a sister bill with eleven co-sponsors in the House, Sen. Hawley’s Safeguarding Women from Chemical Abortion Act, the legislation aims ban mifepristone and enable women who have been harmed by this chemical abortion drug to engage in productive lawsuits against the chemical abortion industry. The legislation parallels several policy concerns raised in points 3, 4, and 5 of Rev. Harden’s 9-Point Protect Women and Children from Abortion Fraud and Injury Plan, which called for federal action addressing chemical-abortion injuries, accountability within the chemical-abortion industry, and the interstate sale and shipment of abortion drugs.
Rev. Harden first published his 9-Point Plan in 2022, more than three years before Hawley introduced the Safeguarding Women from Chemical Abortion Act. Harden expanded the proposal in his 2024 12-Point Plan, calling for federal action on interstate abortion-drug distribution and for Congress to clarify legal personhood from fertilization to natural death.
Rev. Harden congratulates Sen. Hawley for taking a bold stand for life despite opposition from within GOP leadership. Rev. Harden advises Congress that now is not the time to take their foot off the gas. Echoing an argument Rev. Harden has made since Dobbs, Hawley and the signers of the Declaration for Life contend that overturning Roe did not end abortion in America, noting that addressing the chemical abortion issue is the “front line in the defense of life.” With abortion numbers climbing post-Dobbs as the chemical abortion empire leverages the Biden Administration’s removal of in-person dispensing requirement and leniency on the Comstock Act, more women than ever before are at risk of harm due to chemical abortion. Rev. Harden says, “This Act is a much-needed step in protecting women and children from the profiteering chemical abortion empire. I encourage every member of Congress to sign onto this bill before the Midterms, demonstrating moral leadership on this most-important of issues. But we must still address the root: Personhood.”
After a productive month of conversations with leaders in the House and Senate, Rev. Harden unveiled sample language for a Personhood Clarification Act. His is in active conversations with these leaders regarding next actions. In his preamble, Rev. Harden writes,
“Due to the lack of clarity regarding the word ‘Person’ found in the Constitution with respect to the 5th and 14th Amendments, the United States has witness and been party to a history of injustice, disqualifying certain categories of human from personhood status, resulting in human rights abuses. … This act seeks to close that door, safeguarding future generations of Americans from capricious disqualification of personhood, robbing them of equal protection under the law so that society can legally oppress, enslave, or kill that category of human.”
Citing Supreme Court Cases such as Johnson v. M'Intosh, Dred Scott v. Sandford, and Buck v. Bell, which at the time of their rulings resulted in human rights abuses against Native Americans, individuals of African descent, and those with mental disabilities, Rev. Harden says the passage of a Personhood Clarification Act will be the exclamation point of the United States’ commitment to ensuring Constitutional protections extend to all people. He writes:
Therefore, for the purposes of reinforcing the 5th Amendment, guarding against depriving any ‘person’ of ‘life, liberty, or property’ without due process of law and applying the 14th Amendment’s Equal Protection Clause, this Act clarifies the Constitutional meaning of the word ‘Person’ as pertaining to and describing all people, currently extant at and between the moment of fertilization to natural death, possessing uniquely human DNA. This includes the protection of all embryos created via IVF and all individuals at any point in maturation, regardless of genetic abnormalities, ethnic, sex, surrogacy contracts, mental state, or health status.”
